Can you sell co-product chemicals for use as fuels? In some cases, the answer is yes. If your co-product was a non-hazardous waste, then you can sell it for fuel use if you meet the requirements of 40CFR241. If the co-product was a hazardous waste, then you will have to meet the requirements of 40CFR261.2. Generally, hazardous materials that are fuels or fuel ingredients themselves are not solid wastes.
